These Terms of Service govern your access to and use of the Rentably rental marketplace platform. By using our services, you agree to be bound by these terms.
Acceptance of Terms
By accessing or using Rentably ("the Platform"), operated by Rentably Technologies Inc. ("the Company"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you must not use our services. These terms apply to all users, including property owners, property managers, renters, and visitors.
Description of Service
Rentably is a Canadian rental marketplace platform that connects property owners and managers ("Listers") with individuals seeking rental accommodations ("Renters"). Our services include:
- Property listing creation, management, and promotion
- Rental property search with filters, maps, and saved searches
- In-app messaging between Listers and Renters
- Online rental application submission and management
- Viewing scheduling and coordination
- Company and team management tools for property managers
- Lease document templates and management
User Accounts
You must create an account to access certain features of the Platform. By creating an account, you agree to:
- Provide accurate, current, and complete registration information
- Maintain and update your information to keep it accurate
- Keep your password confidential and secure
- Accept responsibility for all activity under your account
- Notify us immediately of any unauthorised access or security breach
- Be at least 18 years of age
User Responsibilities
Listers agree to:
- Provide accurate, truthful property information and photos
- Comply with all applicable federal, provincial, and municipal housing and rental laws
- Respond to enquiries in a timely and professional manner
- Not discriminate against applicants based on protected grounds under the Alberta Human Rights Act or the Canadian Human Rights Act
- Keep listing information current and remove listings when no longer available
- Ensure properties meet all applicable safety and building code standards
Renters agree to:
- Provide truthful information in applications and messages
- Use the platform solely for legitimate rental housing searches
- Not engage in fraudulent or deceptive communications
- Respect the privacy and time of Listers
Prohibited Activities
The following activities are strictly prohibited on the Platform:
- Posting false, misleading, or fraudulent listings
- Harassment, abuse, or threatening behaviour toward other users
- Scraping, data mining, or automated access without written permission
- Circumventing security measures or attempting unauthorised access
- Using the platform to facilitate illegal rental arrangements
- Spamming, phishing, or distributing malware
- Impersonating another person or organisation
Fees and Payments
Rentably offers both free and paid features. Free listings are available to all Listers. Premium features, including enhanced visibility and analytics, may be subject to fees. All fees are in Canadian dollars and are clearly disclosed before purchase. Rentably does not handle rental payments between Listers and Renters.
Intellectual Property
All content on the Rentably platform, including the design, code, logos, and written content created by Rentably, is owned by Rentably Technologies Inc. and protected by Canadian copyright law. User-submitted content (listings, photos, messages) remains the property of the user, but by submitting it you grant Rentably a non-exclusive licence to display, reproduce, and distribute it for the purpose of operating the Platform.
Limitation of Liability
Rentably is a marketplace platform and is not a party to any rental agreement. To the maximum extent permitted by applicable law, Rentably Technologies Inc. shall not be liable for: any rental disputes between Listers and Renters; the accuracy or completeness of listing information; any loss or damage arising from the use of the Platform; or interruptions to service. Our total liability to any user for any claim shall not exceed the amount paid by that user to Rentably in the 12 months preceding the claim.
Termination
Rentably reserves the right to suspend or terminate any account at its sole discretion, without notice, for violation of these Terms or for any conduct that Rentably determines is harmful to the Platform or its users. You may close your account at any time from the account settings page.
Governing Law
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Alberta, Canada.
Changes to Terms
Rentably may update these Terms at any time. We will notify users of material changes by email or by a prominent notice on the Platform. Continued use after changes are posted constitutes acceptance of the updated Terms.
